These Terms of Service (“Terms”) govern your use of Lexica, the website at lexica.io, and related SMS services. Lexica is operated by Sam Starkman (“Lexica,” “we,” “us,” or “our”). By creating a subscription, providing your phone number, or using the service, you agree to these Terms and our Privacy Policy.
1. The service
Lexica sends vocabulary-related text messages (including a Word of the Day and related account messages) to the phone number associated with your subscription. Content is for personal educational and entertainment use. We may update word selection, message format, and delivery timing from time to time.
2. Eligibility
You must be able to form a binding contract and provide a valid mobile number you own or control. You are responsible for complying with any mobile carrier rules that apply to you. The service is not intended for children under 13.
3. Accounts and accuracy
You agree to provide accurate checkout and contact information and to keep it reasonably up to date. You are responsible for activity on your subscription and for safeguarding access to your email and phone number.
4. Subscriptions, billing, and cancellation
- Paid plans are billed through Stripe on the cadence shown at checkout (for example weekly, monthly, or yearly).
- By subscribing, you authorize recurring charges until you cancel.
- You can manage or cancel billing through the Stripe customer portal. Reply MANAGE to the Lexica number for the portal link, or use the billing link provided in account messages.
- If you cancel in Stripe with access continuing until the end of the paid period, you may continue receiving Lexica texts until that period ends, unless you also opt out of SMS as described below.
- Failed payments may result in suspension or termination of the SMS service.
- Except where required by law, fees are non-refundable once a billing period has started.
5. SMS terms
- By subscribing, you consent to receive recurring automated texts from Lexica at the number you provide.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to opt out of Lexica texts, HELP for help, or MANAGE for billing information.
- STOP stops texts; it does not cancel paid Stripe billing by itself. If you have an active paid plan, cancel it in the Stripe portal to stop charges.
- Carriers are not liable for delayed or undelivered messages.
6. Acceptable use
You agree not to misuse Lexica, including by:
- Providing a phone number you are not authorized to use.
- Attempting to disrupt, scrape, or reverse engineer the service in unauthorized ways.
- Using the service for unlawful, harassing, or abusive purposes.
We may suspend or terminate access if we reasonably believe these Terms have been violated.
7. Intellectual property
Lexica branding, site design, and service content are owned by us or our licensors. Word definitions and examples may be generated or curated with third-party tools. You may use messages you receive for personal, non-commercial use. You may not republish the service as a competing product without our permission.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted delivery, perfect definitions, or specific learning outcomes.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEXICA AND SAM STARKMAN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM.
10. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your misuse of the service, your violation of these Terms, or your violation of any law or third-party rights, to the extent permitted by law.
11. Changes to the service or Terms
We may modify the service or these Terms. Material changes will be posted on this page with an updated date. Continued use after changes become effective constitutes acceptance of the revised Terms. If you do not agree, cancel your subscription and stop using the service.
12. Governing law
These Terms are governed by the laws of the State of Connecticut, USA, without regard to conflict-of-law rules. Courts located in Connecticut will have exclusive jurisdiction, except where prohibited by law.
